Terms & Conditions
Please read these terms carefully before using our services.
Last updated: January 1, 2025
These Terms and Conditions ("Terms") govern your use of hydroseeding and related services provided by Louisiana Hydroseeding ("Company," "we," "us," or "our"). By engaging our services, requesting an estimate, or entering into any service agreement with us, you agree to be bound by these Terms.
1. Acceptance of Terms
By requesting a quote, scheduling a service, or authorizing work to proceed - whether verbally, in writing, or by electronic communication - you confirm that you have read, understood, and agree to these Terms and Conditions. If you do not agree to these Terms, please do not engage our services.
These Terms apply to all residential, commercial, and municipal customers of Louisiana Hydroseeding across all service categories including hydroseeding, erosion control, re-vegetation, and restoration.
2. Services
Louisiana Hydroseeding provides professional hydroseeding, erosion control, re-vegetation, and land restoration services throughout Louisiana. The specific scope of work for each project is agreed upon prior to service commencement and documented in the written estimate or service agreement provided to the customer.
We reserve the right to decline any project request at our sole discretion. We also reserve the right to subcontract portions of work to qualified professionals while maintaining responsibility for the quality of the completed project.
3. Estimates & Pricing
All estimates provided are based on the information available at the time of assessment. Final pricing may be adjusted if site conditions, square footage, or project requirements differ materially from those described during the estimate process.
Written estimates are valid for 30 days from the date of issue. Prices quoted verbally are not binding and must be confirmed in writing. Louisiana Hydroseeding is not responsible for price discrepancies arising from inaccurate site measurements or descriptions provided by the customer.
Additional charges may apply for: access difficulties, extreme slope conditions, removal of debris or existing vegetation, multiple mobilizations, and any work beyond the scope defined in the original estimate.
4. Payment Terms
Payment terms are as follows unless otherwise agreed in writing:
- Residential projects: Payment is due in full upon completion of the work.
- Commercial projects: A deposit of up to 50% may be required prior to scheduling. Remaining balance is due within 15 days of project completion.
- Large-scale or multi-phase projects: Payment schedules will be specified in the service agreement.
Late payments are subject to a 1.5% monthly interest charge on the outstanding balance. Louisiana Hydroseeding reserves the right to place a lien on the property in accordance with Louisiana lien laws if payment is not received within 30 days of the invoice date.
We accept cash, check, and major credit cards. Returned checks are subject to a $35 returned check fee.
5. Scheduling & Site Access
The customer is responsible for ensuring that the service area is accessible on the scheduled date, including: gates unlocked and open, vehicles moved, irrigation systems turned off, and the area free of pets, children, and personal property.
If our crew arrives and cannot access the site or the area is not properly prepared, a trip charge may apply and the job will need to be rescheduled. Weather conditions, equipment availability, and other factors outside our control may require rescheduling. We will notify you as soon as possible if a rescheduling is necessary.
6. Limitation of Liability
Louisiana Hydroseeding's liability for any claim arising from our services shall not exceed the total amount paid for those specific services. We are not liable for: indirect, incidental, or consequential damages; loss of use of property; damage caused by pre-existing conditions; or damage caused by the customer's failure to follow post-application care instructions.
We are not responsible for germination failure resulting from: drought, flooding, excessive heat, pest damage, foot traffic during establishment, improper watering by the customer, or other conditions outside our control after application.
Louisiana Hydroseeding carries general liability insurance. A certificate of insurance is available upon written request.
7. Warranty
Louisiana Hydroseeding warrants that our hydroseeding applications will be applied using industry-standard seed blends, mulch, fertilizer, and tackifier appropriate to your site conditions. We do not guarantee 100% germination rates, as successful establishment depends heavily on post-application care, watering, and environmental conditions beyond our control.
If germination failure occurs and is determined to be the result of application error on our part, we will re-apply the affected area at no additional cost, subject to inspection within 30 days of the original application. This warranty does not cover failure due to drought, flooding, animal damage, foot traffic during establishment, or improper watering.
8. Property Conditions
The customer represents that they have the legal right to authorize the requested work on the property. The customer is responsible for marking or identifying any underground utilities, irrigation lines, septic systems, or other buried infrastructure prior to our arrival. Louisiana Hydroseeding is not responsible for damage to unmarked or inadequately marked underground utilities or infrastructure.
Call 811 before any work involving soil disturbance. It is the customer's responsibility to contact 811 if required for the project scope.
9. Cancellation Policy
Customers may cancel scheduled services with at least 48 hours' advance notice without penalty. Cancellations with less than 48 hours' notice may be subject to a cancellation fee of up to 15% of the scheduled job total. Deposits paid on commercial projects are non-refundable if cancellation occurs within 5 business days of a scheduled start date.
Louisiana Hydroseeding reserves the right to cancel scheduled work due to unsafe weather conditions, equipment failure, or other circumstances beyond our control. In such cases, no cancellation fee will apply and we will reschedule at the earliest available date.
10. Dispute Resolution
Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in East Baton Rouge Parish, Louisiana. The prevailing party may recover reasonable attorney's fees and costs.
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana.
